Acceptance of Terms

By accessing or using the Victorian Subdivision Potential Screener (the "Screener"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Screener.

The Screener is provided by SQM Architects, a registered architecture practice in Victoria, Australia.

Service Description and Limitations

Important: Not Professional Advice

The Screener provides indicative estimates only and does NOT constitute professional planning, architectural, legal, financial, or investment advice.

You MUST obtain professional advice from qualified architects, town planners, conveyancers, and solicitors before making any property purchase or development decisions.

What the Screener Does

  • Retrieves property and planning data from Victorian Government databases
  • Applies Victorian Planning Provisions (VPP) zone rules and standards
  • Estimates potential subdivision lot counts based on available data
  • Identifies planning overlays and potential constraints

What the Screener Does NOT Do

  • Does NOT provide professional planning advice or planning permit applications
  • Does NOT conduct site inspections or assess physical site conditions
  • Does NOT guarantee planning approval or council outcomes
  • Does NOT replace professional due diligence or property valuations

Do Not Make Purchase Decisions Based on This Screener

Critical Warning

DO NOT use this Screener as the sole or primary basis for:

  • - Property purchase decisions
  • - Financial commitments or loan applications
  • - Investment decisions
  • - Contract negotiations

Actual subdivision potential may differ significantly from Screener estimates due to:

  • Site-specific factors not detectable by automated analysis
  • Recent planning scheme amendments or local policy changes
  • Council-specific requirements and discretionary provisions
  • Physical site constraints (steep slopes, large trees, easements)

Data Accuracy and Currency

Property and planning data is sourced from Victorian Government databases (Vicmap) and may be:

  • Outdated: Up to 12 months out of date
  • Incomplete: Missing recent planning amendments or overlays
  • Subject to Change: Planning rules can change without notice

Professional Verification Required

Before proceeding with any property purchase or development, you agree to obtain advice from:

  • Registered Architects or Building Designers
  • Town Planners
  • Conveyancers or Solicitors
  • Licensed Surveyors

Limitation of Liability

Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law ("ACL"). Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you may have under the ACL.

Limitation

To the maximum extent permitted by law:

  • Our total liability is limited to AUD $100
  • We are not liable for indirect, consequential, or special damages
  • We are not liable for losses from property purchase decisions

This limitation does not apply to liability that cannot be excluded under the ACL, including liability for misleading or deceptive conduct.

Your Responsibilities

When using the Screener, you agree to provide accurate information, use it for lawful purposes only, and verify all results with qualified professionals before taking action.

Intellectual Property

The Screener, including all content, features, and functionality, is owned by SQM Architects and protected by Australian and international copyright and intellectual property laws.

Privacy

Your use of the Screener is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information.

Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
